California Jail Holds: Warrants, Probation, and ICE

Families lose money when they treat every “in custody” row as a bail problem. A hold is a second agency asking the jail not to release the person even if the local bond is posted. Until you know whether a hold exists, do not assume a surety bond will open the door.

Common hold types
- Same-county additional case: A second local warrant or case with no-bail or a separate bail number.
- Other-county warrant: San Diego cannot clear an Orange County bench warrant by accepting a San Diego-only bond.
- Probation or parole hold: A supervision agency can lodge a detainer after a new arrest. County bail on the new case may not override it.
- ICE detainer: Immigration and Customs Enforcement can ask the jail to notify them before release. Search the ICE detainee locator if you suspect immigration custody.
- Federal pickup: U.S. Marshals or another federal agency. Use the federal inmate locator and read federal vs county vs ICE.
How to check before anyone posts a bond
- Read every line on the roster, not just the first charge.
- Call the jail records or inmate information number for that facility and ask: “Are there any holds, detainers, or other-county warrants?”
- Ask whether bail is set on each case or only on one.
- If ICE is mentioned, do not treat a California surety bond as an immigration bond.
Staff will not always give a family a full legal explanation. They will usually confirm whether the person is “clear to release on the local bond.” That yes/no is the question that matters tonight.
What a hold does to visiting and money
A hold does not automatically cancel visiting. It can change housing or move the person to another facility with little notice. Recheck location the morning of a visit. San Diego visiting: county visiting guide.
Money on books still helps with commissary. It does not lift a detainer.
If the local case is the only thing holding them

Can I post bail on the local case and deal with ICE later?
Sometimes the local case clears and ICE takes custody at the door. That is not a “release home.” Ask records before you pay.
Will the roster always show “ICE”?
No. Some systems only show a generic hold. Call the facility.
Does a hold mean the person cannot have a lawyer?
No. Counsel is a separate track from the jail’s release checklist.
